Tarksol, Inc. Sues Tarksol International L.L.C. and Others for Multiple Wrongful Acts and Misrepresentations as to Patent Rights

( Rochester , New York ) – Tarksol, Inc. of Rochester, New York, an innovator and supplier of specialty cleaning and coating products having improved environmental properties, has, together with A.R.K. Patent International, L.L.C., and A. Richard Koetzle, commenced legal action against Tarksol International L.L.C. of Reno, Nevada, Amrex Chemical Company, Inc. of Binghamton, New York, and others for multiple counts of unlawful conduct relating to an invention, patented by Mr. Koetzle, for chemical solvents having increased flash points.  The invention claimed in the patent, which issued on September 25, 2007 as No. 7,273,839, enables the transportation and use of coating and cleaning compositions that otherwise could be restricted by Federal regulations.

The complaint, filed on September 11, 2007 in New York State Supreme Court in Rochester, states that A.R.K., the true owner of the patent, had terminated for cause the license granted earlier to Tarksol International and alleges multiple claims of wrongdoing by the defendants, including breach of contract, unjust enrichment, interference with contractual relations, unlawful conduct to restrain competition, misrepresentations as to patent ownership, and misappropriation of trade secrets.  The complaint further demands treble damages and injunctions against the unlawful conduct and the use of the names “Tarksol” and “Tarksone.” 

Mr. Koetzle, the President of Tarksol, Inc. and the inventor of the patented technology, confirmed that separate steps had been taken before the U.S. Patent and Trademark Office to undo Tarksol International’s misrepresentations as to patent ownership.  He expressed optimism that the New York Court will recognize the substantial wrongdoing committed by the defendants and will find for Tarksol, Inc. and the other plaintiffs.  Adding that the cloud on the patent having been lifted and the license to Tarksol International terminated, he confirmed that chemical companies, who until now may have been reluctant to do business with Tarksol, Inc., now may feel free to do so and benefit from the patented technology.
